Candy Corner 1 licence revoked

The premises licence for the Candy Corner 1 mini-mart in Blaby village has been revoked by members of Blaby District Council’s sub-licensing committee. 

The decision means the store, currently under a three-month closure order granted by Leicester magistrates on July 20, can no longer sell alcohol when it reopens. 

Under licensing legislation if a business is the subject of a court closure order the local authority must review any premises licence granted to that business. 

As well as this Leicestershire Police had already called for a review prior to the closure order.  

In reaching its decision, the sub-committee considered all relevant information, evidence and officer advice. The review was heard in private session in accordance with the provisions of the Local Government Act 1972. 

Complaints related to a failure to have a copy of the licence on display at the premises, not having a refusal log, failure to retain CCTV coverage for the required period of time set out under the licence and some allegations of underage sales and potential associated disorder. 

Sub-committee chairman, Councillor Roger Stead, said: "Our remit was to determine the matter before us which centred solely on whether it was appropriate for the business Candy Corner 1 to continue to hold a premises licence to sell alcohol. 

"After considering the evidence it was our determination that the most suitable and responsible course of action would be to revoke the licence. As a Licensing Authority we are committed to protecting residents and work closely with partners to address concerns. 

"Our decision demonstrates we are determined to act where appropriate and use regulatory powers in the public interest."
