Article 4 Direction - Braunstone Village Conservation Area

Background

Following designation of the Braunstone Village Conservation Area in 2024 a non-immediate Article 4 Direction was made on 20 March 2025 in relation to certain properties within the area. Following public consultation the Council has now confirmed the Direction.

The Article 4 Direction is in force as of 24 March 2026.

What is an Article 4 Direction?

An Article 4 Direction is a planning control that can be used to restrict ‘Permitted Development’ rights (works that can be done without having to make a planning application) on certain properties or an area. This does not mean development cannot take place, however an application would be required so that the details of the proposal can be properly assessed.

During the appraisal of the Braunstone Village Conservation Area, a number of properties were identified where this Direction should apply in the interests of the historic character of the area

What do the restrictions involve?

The Direction restricts permitted development rights as set out in The Town and Country Planning (General Permitted Development) (England) Order 2015 with regards to:

Development within the curtilage of a dwellinghouse comprised within the following classes of Part 1 of Schedule 2 to the said Order:

Class A – enlargement, improvement, or other alteration;
Class C – alterations to the roof;
Class D – the erection or construction of a porch outside any door;
Class F – hard surfaces incidental to the use of a house.

Minor development comprised within the following classes of Part 2 of Schedule 2 to the said Order:

Class A – Erection of fences and gates;
Class C – the painting of the exterior of any building or work.

The restrictions apply to the properties 228, 230, 230a, 236, 238, 240, 242, 244, 246, 248, 250, 256, 268, 270, 272, 274, 276, 278 Braunstone Lane.
