Exempt Buildings and Works

With certain exceptions, the Building Regulations do not apply to the classes of buildings specified in Schedule 2 of the Building Regulations 2010. These exemptions include:

  • Small detached single-storey buildings, so long as the floor area does not exceed 30 square metres, the building contains no sleeping accommodation and is either situated not less than one metre from the boundary of its curtilage, or is constructed substantially of non-combustible material
  • Greenhouses, provided they are not used for retail, packing or exhibiting purposes
  • The extension of a building at ground floor level by the provision of conservatory, porch, covered way or carport which is open on two or more of its sides. In each case, the floor area must not exceed 30 square metres
  • In the case of a conservatory or porch which is wholly or partly glazed, the glazing must meet the requirements for glazing set out in Part N of Schedule 1 of the Building Regulations 2000 "Glazing – Protection Against Impact"
  • The separation between the conservatory or porch should be maintained using an external grade door. The existing heating system should not be extended into the conservatory or porch
  • The installation of heat-producing gas appliances provided they are installed by a person approved by the Gas Safety (Installation and Use) Regulations 1984
  • The provision of electrical installations provided they are installed by a person registered with a Competent Person's Scheme for Part P - Electrical Safety
