                           premisesThe Gambling Act came into force on 1st September 2007 and creates a new regulatory system to govern the provision of all gambling in Great Britain, other than the National Lottery and spread betting.

The Act removes from the licensing justices all responsibility for granting gaming and betting permissions and introduces for the first time a unified independent regulatory body for the gambling industry, the Gambling Commission. The Gambling Commission regulate the gambling industry and local authorities are responsible for issuing Gambling Premises Licences, Gambling Permits, and other required authorisations.

How to apply for a licence

  1. Complete the appropriate application form
  2. Attach any supporting documents
  3. Attach a plan of the premise (where applicable)
  4. Attach the application fee (where applicable)
  5. Send copies of application to the Responsible Authorities (see list below)

Since September 2007 Blaby District Council became responsible for the Licensing of premises within the boundary of the district where gambling activities take place, as part of reforms under the Gambling Act 2005.

Premises licences will be granted by licensing authorities and may authorise the provision of facilities on;

  • casino premises
  • bingo premises
  • betting premises, including tracks
  • adult gaming centres
  • licensed family entertainment centres

There are various forms available to those applying for a premise licence, and the one for you will depend upon the type of gambling to be conducted on the premise. You will also find that there are forms which are to be used to give notice of your application to Responsible Authorities and to the Public. The various application forms and official notices of application are provided on this site.

Please ensure that you consider the following in order to avoid any delay in the processing of your licence application.

Your licence application should include the relevant Gambling Premise licence fee together with a scaled plan of the premise (see the document detailing the plan requirements).

Copies of Premises Licence applications should be submitted to 'Responsible Authorities'. A list of Responsible Authorities is also available on this site.

Transfers

An application can be made to transfer the licence holder into another name. The person to whom it is transferred must have an operating licence for the licence to have effect.

Variations

If a Licensee wishes to change a detail of their Premise Licence they may choose to submit an application to vary to the Licensing Authority. A Premise Licence can be varied in three ways:

  • adding, amending or removing an authorised activity
  • amending another detail of the licence
  • excluding a default condition and/or a condition imposed by a Licensing Authority

Provisional Statement

A person may make an application to the Licensing Authority for a Provisional Statement in respect of a premise that he or she expects to be constructed, altered, or acquire a right to occupy.

Temporary Use Notices

Temporary Use Notices (TUN) allow the use of premise for gambling where there is no Premise Licence, but where a gambling operator wishes to use the premise temporarily for providing facilities for gambling.

A Temporary Use Notice must be lodged with the Licensing Authority not less than 3 months and 1 day before the day on which the gambling event will begin.

In addition a copy of the notice must also be served within 7 days on;

  • the Gambling Commission
  • the Chief of Police
  • HM Revenues and Customs
  • any other Licensing Authority in whose area the premises are situated

The Gambling Act 2005 refers to a set of premises and provides that a set of premises is the subject of a TUN if ‘any part’ of the premises is the subject of a Notice.

The same permits may not be the subject of a temporary use notice for more than 21 days in any 12-month period, but may be the subject of several notices provided that the total does not exceed 21 days.

Annual Fees

A number of licences and permits require the payment of an annual fee (most due within 30 days of receipt of the licence/permit and annually thereafter). You will be advised in writing of this fee (if applicable).
