Hotels and Guest Houses
Here it is explained how the smokefree legislation will affect hotels and guest houses.
What is required
Signage
No smoking signs must be displayed at entrances. These signs must comply with the Smokefree
(Signs) Regulations 2007.
Smoking bedrooms
You do not have to provide designated bedrooms. If however you do want to, this is allowed.
These bedrooms must be designated in writing as ‘Smoking allowed rooms’ and a register containing the identity of these
rooms must be kept with the management and must be available for inspection by enforcing officers at all time. Staff however,
will not be permitted to smoke in these rooms.
Keeping smokefree areas smokefree
The owner of the business must ensure that no one smokes in the smokefree areas. The owner is required to take all reasonable
action to ensure the staff and premises comply with the regulations and that guests understand and comply with the law whilst
staying at the premises.
Failure to comply
- Smoking in a smokefree place can result in a fixed penalty notice of £50 or a fine of £250 for non compliant members of
the public and guests.
- Failure to display appropriate signs can result in a fixed penalty notice of £200 or a fine of up to £1000 for non complaint
business owners.
- Failing to prevent smoking in a smokefree place can result in a fine of up to £2,500 for non compliant business owners.
