Appeals

What can I do if I think my bill is wrong ?

If you think you Council Tax bill is incorrect, you have the right to appeal. However you should continue to pay in accordance with your original bill whilst your appeal is pending.

On what grounds can I make an appeal ?

You can make an appeal if you think : -

  • The wrong person is named as liable for the Council Tax
  • You believe your home should be exempt from any liability
  • The amount of the bill is incorrect, for example, a discount should apply and has not been granted.

How do I go about making an appeal ?

There are two stages to the appeals process :

STAGE 1 : Representations

Your appeal should be made to the Revenues Section, in writing, stating who you are, where you live and details of what decision you are appealing against.

The Council then has two months to consider your comments.  If the Council rejects your arguments or fails to reply within the two month period, you can appeal to a Valuation Tribunal.  Any appeal to the Valuation Tribunal must be made within 2 months of receiving a reply from the Council or 4 months from the date of your original appeal.

STAGE 2 :Appeal to Valuation Tribunal

Your appeal to the Valuation Tribunal should be made in writing, stating the decision you are appealing against and why. If you and all other parties agree, your case can be dealt with by exchange of written representations. If this is not satisfactory the Tribunal will contact you to make arrangements for a formal hearing and will provide you with information explaining the procedures in detail. A hearing will usually last no longer than a day and will not cost you anything, unless you decide to employ a solicitor to represent your case for you.

If the Tribunal decides in your favour the Council will revise your bill and adjust any necessary payments or details.

If the Tribunal decides in the Councls favour, then payments should be made immediately to bring the account up to date.
