Summary

The Council is in the process of implementing controls in relation to street trading across the district. The Council have adopted street trading controls and approved a policy which applies to street trading within Blaby.

The new controls come fully into place on 1st April, 2012 and after this date it is an offence to undertake street trading within Blaby without the benefit of a consent.

What does street trading include?

Street Trading is defined as the selling or offering for sale of any article in the street. This includes food such as burgers, kebabs, doughnuts etc. or other things such as household items.

If you sell any article on the streets of Blaby, or any other public open area where the public have access without payment, then you need to apply for a Street Trading Consent. All streets in this district are designated as consent streets.

No trading can take place on consent streets unless a permit has been granted, and then only in accordance with any conditions attached.

You do not need a Street Trading Consent if you are:

  • Trading as a Pedlar under licence issued by a Police Authority
  • A market trader operating at a licensed market venue
  • A news vendor selling only newspapers and periodicals
  • If you are trading on private land you may not need a consent

How do I apply for a consent?

The Council are in the process of setting up an online application system for existing traders who require a consent from 1st April, 2012. This will be available before the end of January 2012 and will allow applications to be submitted electronically.

How much does it cost?

The fee set by the Council for a consent is £350 per annum.

What happens once an application is made?

The Council will send a copy of the application to County Highways, Leicestershire Police, Leicestershire Fire and Rescue Service, the relevant Parish Council and District Councillor to request their comments.

The Council will assess the application and comments received in relation to the potential impact on public health, public safety and protection of the environment. If no or only minor issues are identified then a consent will be granted (with or without conditions). If major issues are identified then it is likely that the application will be refused.
