Licence - alcohol entertainment
                           and late night refreshments The Licensing Act 2003 gives Licensing Authorities responsibilities relating to the licensing of alcohol including pubs, restaurants, registered members clubs, regulated entertainment including live music, discos, indoor sporting events, showing films etc and the provision of late night refreshment (hot food and drink supplies after 11pm and before 5am).

You may be unsure if your business needs a licence or you may require further information if you are applying for a licence under this Act for the first time so please read the guidance notes (download below). The guidance contains basic information to help you in making a successful application.

You may need a licence if you are organising a one off event, which includes entertainment, alcohol sales or late night refreshment. Your event may need a Premises Licence which you should apply for at least 2 months prior to the event date, although most small events (accommodating up to 499 people at any one time) can be covered by submitting a Temporary Event Notice (which must be received by this Licensing Authority at least 10 working days prior to the date of the event – excluding the date of the event and the date of submission).

How to apply for a licence

  1. Choose and complete the appropriate application form/notice whilst referring to the appropriate guidance notes at all times
  2. You may wish to make an appointment or contact a member of the Licensing Section to discuss your application prior to submission
  3. Submit the application form or notice along with the correct payment and supporting documents/consent forms (see the checklist at the end of each application/notice). Cheques should be made payable to Blaby District Council
  4. Send copies of your application to the appropriate Responsible Authority(s) (see downloads section below for list of responsible authorities)
  5. Advertise your application as required (see the guidance notes for further information)
  6. If there are objections/representations against your application the Licensing Authority will arrange for a hearing to be held to determine the application
  7. In general most decisions can be appealed through the Magistrates Court

A premises or place where licensable activities will be conducted will need to be covered by a licence or notice.

Licensable Activities

The following activities are required to be licensed;

  • The retail sale of alcohol
  • The supply of alcohol by or on behalf of a club to a member of the club
  • The provision of regulated entertainment
  • The provision of late night refreshment

All applications are based around the four Licensing Objectives, which are;

  • The prevention of crime and disorder
  • Public Safety
  • The prevention of public nuisance
  • The protection of children from harm

There are a number of licences and notices issued under the Licensing Act 2003, including;

  • Personal Licence - issued to an individual
  • Premises Licence – issued to a premises/area
  • Club Premises Certificate – for a non commercial members club
  • Temporary Event Notice – for occasional events (limits apply)

In addition to new applications, licence holders may wish to amend or update details. Licences can be updated in a number of ways;

  • Variation to a Premises Licence/Club Premises Certificate This would be used to allow minor alterations to a licence.
  • Transfer a Premises Licence

    This would be used to transfer the licence from one person/company to another.

  • Vary the Designated Premises Supervisor (DPS)

    This would be used to change the named DPS on a licence which authorises the retail sale of alcohol.

  • Change to a name or address

    The Licensing Authority shall be advised in writing of any name or address change whilst a licence is valid.

Licence Reviews

There is a process for reviewing licences if problems were to persist at a licensed premises. Initially the Licensing Authority will try to resolve the issues informally with the parties concerned but if this was to be unsuccessful a Responsible Authority or Interested Party may apply to Review a licence.

The reasons for the Review of a licence must relate to one or more of the four licensing objectives.

Responsible Authorities include the Police, Trading Standards, Fire Service, the Planning Authority and Environmental Health.

Interested Parties include a person living in the vicinity of a licensed premises, a body representing a person living in the vicinity, a person involved in a business which is located in the vicinity of a licensed premises or a body representing persons involved in such businesses.
